As the name implies, worker's compensation is designed to compensate injured workers. It replaces approximately 2/3 of an injured worker's pre-injury weekly wage and provides for his or her medical treatment after an injury, so that the worker may return to work as quickly as possible. A fraction of lost wages and medical benefits are the only benefits one may seek when filing a Georgia workers' comp claim (i.e., no pain and suffering, punitive damages, etc.). While this may seem an inadequate method of compensation after an injury, the system was designed to be "no fault" and efficient (moreso than would be a negligence action), so that a claimant can get relief and get back to work as quickly as he/she is able. Stated simply, one must only have an injury arising out of, and in the course of, his employment for the accident to qualify as a workers' comp claim.
